Terms of Service

These Terms of Service ("Terms") govern your use of the Certisafe One platform (the "Service"), operated by Certisafe One. By creating an account or using the Service, you agree to these Terms.

1. Definitions

"Building Manager" refers to a user operating in a client or admin capacity responsible for building safety oversight. "Contractor" refers to a user operating in an operative or director capacity performing or managing remedial fire safety work. "FIRAS" refers to the third-party certification scheme for passive fire protection installers. "Content" means all data, photos, documents, and information uploaded or generated through the Service.

2. Eligibility & Accounts

You must be at least 18 years old and have the legal authority to bind your organisation. You are responsible for maintaining the security of your account credentials and for all activity under your account. You agree to provide accurate company information during registration, including your registered company number and address.

3. Subscription Plans & Payment

The Service is offered on a subscription basis with two plans: the Building Manager Plan ($99.99/month) and the Contractor Plan ($29.99/month). Subscriptions are billed monthly in advance via Stripe. You authorise recurring charges until you cancel. Cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

We may change pricing with at least 30 days' notice. Existing subscribers will be charged the new rate at the next renewal after notice.

4. Permitted Use

You may use the Service to document, track, and certify passive fire safety remediation work, manage building safety information, and generate compliance records. You agree not to: (a) use the Service for any unlawful purpose; (b) upload Content that infringes the rights of any third party; (c) attempt to access data belonging to other users without authorisation; or (d) reverse engineer or disrupt the Service.

5. User Content & Data Ownership

You retain ownership of all Content you upload. By using the Service, you grant Certisafe One a licence to host, process, and display your Content solely to provide the Service to you and authorised users you have shared access with. You are responsible for ensuring you have the rights to upload all Content, including photographs of buildings and premises.

6. Certificates & Compliance Records

FIRAS certificates and compliance documents generated through the Service are based on information provided by users. Certisafe One does not verify the accuracy of operative accreditation, product details, or photographic evidence. The responsibility for accurate, truthful certification lies with the certifying operative and their organisation. Certisafe One is not a substitute for regulatory compliance with the Building Safety Act 2022 or any other applicable legislation.

7. AI-Generated Estimates

The Service may provide indicative cost estimates generated by artificial intelligence. These estimates are for guidance only, are not binding quotations, and may not reflect actual costs. You should obtain formal quotations from qualified contractors before commissioning any work.

8. Acceptable Use & Safety

Photographic evidence uploaded to the Service includes device-captured timestamps. Tampering with or misrepresenting the timing or authenticity of evidence is strictly prohibited and may result in immediate account termination. Misrepresented evidence may also carry legal consequences under applicable fire safety and fraud legislation.

9. Intellectual Property

The Service, its design, features, and underlying technology are the intellectual property of Certisafe One. See our Copyright Policy for details. These Terms do not grant you any rights to our trademarks, logos, or proprietary software.

10. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you breach these Terms, fail to pay fees, or engage in conduct that we determine is harmful to the Service or other users. Upon termination, you may export your data for a period of 30 days, after which it may be permanently deleted.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Certisafe One shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
